The petitioner, who is in custody, seeks bail in connection with Tekari P.S. Case No. 06 of 2017 registered for the offence punishable under Section 304(B)/34 of the Indian Penal Code.
The informant is the father of the deceased who has alleged in this written complaint that his daughter was married with petitioner and on account of non-fulfillment of demand of dowry she was killed by her in-laws by setting her on fire. The statement of the deceased was recorded in the hospital by the police on 03.12.2016 in which she had admitted that she died of accidental fire and nobody is responsible for such incident. The
Patna High Court Cr.Misc. No.60045 of 2017 (3) dt.16-01-2018 2/2 FIR was instituted on 22.12.2016 after death of the deceased by the informant but subsequently after he realized that it was a accidental death and he filed a compromise petition in the concerned court. In view of the facts that the deceased's statement was recorded in which she had denied of setting her ablaze and has admitted that she caught fire was accidental and petitioner was not responsible for this incident. It has been further submitted that petitioner has no criminal antecedent and he is in custody since 24.10.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 6th Additional Chief Judicial Magistrate, Gaya, in connection with Tekari P.S.
