Petitioner seeks bail in a case registered for the offences punishable under Sections 384, 386/34 of the Indian Penal Code and Sections 17, 20, 21 of the U.A.P. Act. The petitioner was apprehended along with cash of Rs.2,43,000/- (Rupees Two Lacs and Forty Three Thousand). Allegation is that the money was collected as levy on behalf of the extremist group.
Submission of learned counsel for the petitioner is that the recovered amount was part consideration money paid in pursuance of an agreement to sale between Vilkish Hussain and Sharmila Devi, wherein petitioner was a middle man, which would be evident from the affidavit at Annexure 2. A copy of the
Patna High Court CR. MISC. No.59720 of 2019(2) dt.30-09-2019 2/2 agreement was produced for perusal of the Court. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Rajauli Police Station Case No.273 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
