1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 352, 351(2), 351(3) of the Bharatiya Nyaya Sanhita read with 27 of the Arms Act.

Patna High Court CR. MISC. No.63927 of 2025(2) dt.23-09-2025 2/3 arguments seeks permission to withdraw the anticipatory bail application with respect to petitioner no. 1, 2, 3, 5 and 6.

4. Permission is accorded.

5. The anticipatory bail application is dismissed as withdrawn with respect to petitioner no. 1, 2, 3, 5 and 6.

Learned counsel for the petitioner submits that petitioner no.4 is a person with clean antecedent and is a woman and the informant alleges that he along with his nephew were intercepted by Muneshwar who asked them not to interfere in the work of his son and grandson, on which, informant said that they indulged in liquor trade, on which, accused persons were called by Muneshwar and Mithun started firing causing fire arm injury to his nephew, Bal Kishun and Sushila Devi, who were taken to hospital.

7. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant being the daughter-in-law of Muneshwar Paswan. It is submitted that she has been implicated in the case only with a view to coerce the male members into submission and specific allegation of firing is against Mithun.

8. Learned A.P.P. for the State opposes the anticipatory bail application.

Considering the submissions made on behalf of the petitioner and taking into consideration the fact that petitioner is a woman, the above-named petitioner no.4, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Dalsingsarai P.S. Case No. 128 of 2025, subject to the conditions as laid down under Section 482 (2) of BNSS.

10. Accordingly, the instant anticipatory bail application stands partly allowed.
