The petitioner is in custody since 07.07.2019 in connection with Kundwa Chainpur P.S. Case No. 108/2019 registered for the offence punishable under Sections 272/273/ 414 of the IPC and Section 30(a)41(1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries of Nepali Saufi liquor were not from the conscious possession of the petitioner, but was allegedly saddled on his shoulder. It is further submitted that the petitioner has no criminal antecedents.

In view of the aforementioned facts and
