This is an application for grant of anticipatory bail in connection with Chiraiya P.S. Case No. 228 of 2017 registered for the offence punishable under Sections 304B and 34 of the Indian Penal Code.
The allegation is regarding killing of the deceased lady on account of want of dowry.
The learned counsel for the petitioners submits that the main accused in the present case is the husband of the deceased lady, who is already behind bars. It is further submitted that the present petitioners are the brother-in-laws of the deceased lady and there is general and omnibus allegation against them.
Patna High Court Cr.Misc. No.63141 of 2017(3) dt.19-03-2018 2/2 Hence, it is a fit case in which the privilege of anticipatory bail should be granted to them. It is further submitted that the petitioners have a clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Chiraiya P.S. Case No. 228 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
