2. The petitioner seeks regular bail in a case registered for the offence under Sections 395 and 397 of the Indian Penal Code.

3. The allegation against the petitioner is of looting Rs. 10,000/- and a mobile phone.

4. At the very outset, learned counsel for the petitioner has offered to pay Rs. 20,000/- to the informant without accepting his guilt. He further submits that there is no material against the petitioner and similarly situated co-accused persons have been granted bail vide Cr. Misc. No. 51849 of 2023 dated 17.08.2023 and Cr. Misc. No. 54678 of 2023 dated 25.08.2023 and the petitioner is in jail since 13.06.2023.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed. The petitioner will produce a demand draft of Rs. 20,000/- in the name of the informant which shall be handed over to the informant by the court below.

7. After the demand draft is produced by the petitioner, the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Madhubani/concerned Court below in connection with Rahika P.S. Case No. 75 of 2023 subject to the condition that:- 7(1). The petitioner will mark his attendance at the Rahika Police Station on the first and third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
