JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2020 This is an application for grant of anticipatory bail in connection with Birpur (Balua Bazar) P. S. Case No. 116 of 2019 disclosing offences under Sections 302, 328, 34 of the Indian Penal Code.
As per F.I.R. informant has received an information that his son has taken poison. On that information, he has gone to the hospital and saw the dead body of his son. It is alleged that the petitioner, who happens to be the wife of the deceased and her other family members have administered poison, due to which, he succumbed injuries.
Learned counsel for the petitioner has drawn my attention towards the impugned order, which shows that several witnesses have stated that due to the dispute between the wife and husband, the deceased has taken poison and during
Patna High Court CR. MISC. No.59993 of 2019(4) dt.08-01-2020 2/2 treatment he died. Apart from that there is only facts against the petitioner that the dead body of the deceased was found at the door of the petitioner and the witnesses have also stated that the deceased came at the door of the petitioner and fell down. Heard learned A.P.P. also, who also does not controvert the above facts.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M., Birpur, Supaul, in connection with Birpur (Balua Bazar) P. S. Case No. 116 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
