2. The petitioner seeks regular bail in a case registered for the offence punishable under Section 96 of Bharatiya Nyaya Sanhita.
3. It is alleged that this petitioner enticed and kidnapped the daughter of the informant.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that the victim herself eloped with the petitioner voluntarily and due to love affairs, she solemnized marriage with the petitioner. The victim has not made any allegation against the petitioner in her statement recorded u/s 180 and 183 of B.N.S.S. The victim has also denied
Patna High Court CR. MISC. No.65163 of 2025(3) dt.15-11-2025 2/2 the medical examination. The victim is habitual to fled away with the petitioner for which earlier one case was also lodged by the informant. The charge-sheet has already been submitted after completion of investigation. Petitioner is a young boy of 21 years and he is in custody since 24.04.2025. Petitioner undertakes to co-operate in the trial. There is no chance of tampering with the evidence or absconding of the petitioner.
5. Learned A.P.P. for the State opposes the bail application of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, submissions of learned counsel for the parties and period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Sherghati in connection with Sherghati P.S.
