JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Chowk P.S. Case No. 210 of 2019 registered for the offences punishable under Sections 147, 148, 149, 353, 427, 308 and 188 of the Indian Penal Code, pending in the court of A.C.J.M.-II, Patna City.

As per allegation petitioner was arrested by the Municipal Corporation Authority during removal of encroachment and it is alleged that 70-80 persons assembled there got him freed.

Submission of learned counsel for the petitioner is that there is general and omnibus allegation against the petitioner and he is ready to abide by any condition that may be imposed on him if bail is granted.

Heard learned APP also.

Patna High Court CR. MISC. No.60179 of 2019(2) dt.23-09-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered and disposed of on the basis of materials available on the record, without being prejudiced by this order and, if possible, on the same day.

This application is, accordingly, dismissed.
