1. Heard learned counsel for the Petitioner and learned APP for the State.
2. Petitioner apprehend his arrest in connection with Karpi P.S. Case No. 337 of 2022 dated 21.12.2022 registered for the offences punishable under Sections 341, 323, 308, 504 and 506 read with Section 34 of the Indian Penal Code.
3. The main submissions advanced by learned counsel for the petitioner are that there is no serious allegation against the petitioner and as per FIR, the informant simply asked the petitioner not to play the musical instruments and the allegation of assaulting is against the co-accused persons and both the parties are relatives, residing in the same house and the petitioner is a young person having no criminal antecedent.
4. Learned APP appearing for the State has opposed
Patna High Court CR. MISC. No.69331 of 2023(2) dt.07-11-2023 2/2 the prayer for bail of the petitioner.
5. Considering the above submissions and mainly the genesis of the occurrence and the nature of allegation appearing against this petitioner, this Court is inclined to accept his prayer for anticipatory bail. Accordingly, let the petitioner namedabove, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Karpi P.S. Case No. 337 of 2022, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
