Petitioner seeks bail in a case registered for the offences punishable under Sections 364A, 302, 201 and 120B of the Indian Penal Code.
Murder of the son of the informant was committed for non-fulfillment of demand of ransom. Some witnesses stated that the victim was seen along with co-accused Vickey Kumar @ Vikash Kumar on a motorcycle. In the confessional statement of Vickey Kumar, name of the petitioner surfaced as co-culprit. Petitioner has got no criminal antecedent. Petitioner is in custody since 04.04.2019. Investigation of the case is already complete against the petitioner.
Since there is no direct and substantial evidence against the petitioner, let the petitioner, above named, be
Patna High Court CR. MISC. No.60192 of 2019(2) dt.30-09-2019 2/2 released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Siwan Muffasil (Madadeva O.P.) Police Station Case No. 152 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
