JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 30-06-2021 The instant application has been filed for restoration of Cr. Misc. No.42731 of 2017 which was dismissed for want of prosecution vide order dated 24.07.2019. Learned counsel for the petitioner submits that on 24th July, 2019 he was indisposed and as such he did not appear before the Court when the matter was called out. He submits that there was no deliberate or wilfull laches either on the part of the petitioner or his counsel.

Learned counsel for the State does not oppose the prayer for restoration of the application.

Considering the submissions made at the Bar, the application is allowed.
