JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Baligaon P.S. Case No.75 of 2015 instituted for the offences under Sections 272, 273, 420, 120B of the Indian Penal Code and Section 47(a) of the Excise Act.

The allegation is regarding allowing the customers to drink liquor in the licensed shop of one Navdip Chandra Prasad and the petitioner is said to be the Manager of the said shop. However, several bottles of liquor were also seized. The learned counsel for the petitioner submits that the allegations levelled are false and the said shop is having a valid

No.61160 of 2017 (2) dt.21-12-2017 2/2 licence and no such activity as alleged was going on in the said shop and the fact is that the petitioner is only a representative of the liquor company and he was on a visit to the said shop. It is further submitted that the petitioner has got a clean antecedent. It is further submitted that the petitioner is accused in three other cases in which he is already on bail. The petitioner is languishing in custody since 29.10.2017.

Considering the nature of accusation and the period of custody already undergone, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs.50,000/- (rupees fifty thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Cum Special Judge, Vaishali at Hajipur in connection with Baligaon P.S. Case No.75 of 2015.
