1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Harlakhi P.S. Case No. 65 of 2023 registered under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to dirty village politics. Further he submits that from perusal of the seizure list, it is apparent that the alleged recovery has been made from the land of Dasai Sahani. Further he contended that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the concerned Court within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Additional Sessions Judge-IIcum-Special Judge (Excise Act), Madhubani in connection with Harlakhi P.S. Case No. 65 of 2023, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) shailendra/- U T
