The plaintiff in the suit for partition is the petitioner in this application questioning the legal sustainability of the impugned order by which the learned court below has allowed the prayer of the respondent no. 8 to be added as party defendant in the suit. From the materials on record and perusal of the impugned order, it transpires that the respondent no. 8 has claimed right, title and interest over the suit property on the basis of the registered gift deed dated 31.03.2011 executed by respondent no. 4 Satish Kumar in favour of respondent no. 8 Smt. Anjani Kumari. The learned court below after considering the facts and circumstances of the case has allowed the prayer of the respondent no. 8 to be impleaded as party defendant in the suit.
