JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 This is an application for grant of anticipatory bail in connection with Nasriganj P. S. Case No.93 of 2019, disclosing offence under Section 392 of IPC.

As per F.I.R. three criminals robbed Rs.82,252/- of informant. Apart from that they have also taken away Samsung Tab and some documents on the gun point. Petitioner is not named in the F.I.R. It appears that his name transpires during the course of confessional statement of the co-accused persons. Apart from that he has two criminal cases, one of under Section 392 of IPC and another of under Section 25(1-b)a, 26/35 of Arms Act.

Submission of the learned counsel for the petitioner is that except confessional statement there is nothing against him. Heard learned A.P.P., who has opposed the prayer for anticipatory bail on the ground that he is accused in two more

Patna High Court CR. MISC. No.59693 of 2019(2) dt.23-09-2019 2/2 cases. There is confessional statement of co-accused and the custodial interrogation of the petitioner in such type of cases is required.

Having heard both sides, in view of the facts, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail.
