2. In the present case, the petitioner seeks bail in connection with Fatehpur P.S. Case No. 683 of 2024 registered for the offences under Sections 303, 111(2) (ii), 111(3), 111(4), 111(5), 112(2) of the BNS and Section 21 of the MM (D&R) Act, 1957 and Rule 56 of BM (CPIMTS) Rule, 2024.
3. As per prosecution case, petitioner and other coaccused persons were involved in illegal mining and transportation of sand.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Petitioner has been working as a labourer and were loading/unloading sand at the instruction of his employer. The offence as alleged in the FIR are not made out
Patna High Court CR. MISC. No.64984 of 2025(2) dt.17-09-2025 2/3 against the petitioner as there is no allegation of entrustment, cheating, inducement and theft. Nothing incriminating has been recovered from the person or possession of this petitioner who has been made accused in this case due to highhandedness of the police. A number of co-accused persons have been granted bail vide a common order dated 09.05.2025 passed in Cr. Misc. Nos. 9008 of 2025, 14448 of 2025 and 18151 of 2025. Petitioner is having antecedent of three cases and he is on bail in all such cases. Petitioner is in custody since 09.06.2025 and charge-sheet has been submitted.
5. Learned A.P.P. opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner and submission of chargesheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya/ concerned court in connection with Fatehpur P.S. Case No. 683 of 2024, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions:
Patna High Court CR. MISC. No.64984 of 2025(2) dt.17-09-2025 3/3 (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
