2. In this case, the petitioner is seeking regular bail in connection with Powakhali P.S. Case No. 43 of 2024, registered for the offences punishable under Sections 334(1), 303(2) of the BNS.

3. As per prosecution case, on 06.08.2024, at about 7 pm, the informant closed the jewellery shop and went away. Next morning, when he opened the shop, he found that the brick wall of the shop was cut and some unknown theives had stolen 40 bhar silver ornaments.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. He further submits that except the confessional statement, there is nothing in the entire investigation. The

Patna High Court CR. MISC. No.68241 of 2024(2) dt.30-09-2024 2/2 confessional statement is not leading to recovery as such it has no evidentiary value in the eye of law. The petitioner is under custody since 10.08.2024.

5. On the other hand, learned APP for the State has vehemently opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Kishanganj in connection with Powakhali P.S. Case No. 43 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
