The petitioner, already in custody, seeks bail in connection with Gopalpur P.S.Case No. 101 of 2013 registered under Sections 302/34 of I.P.C. and Section 27 of Arms Act. Allegation in brief is that accused persons after killing the son of the informant escaped away and the informant saw them escaping away.

Learned counsel for the petitioner submits that no one is the eye witness in this case and other co-accused persons were granted bail by a co-ordinate bench of this Court and the petitioner is in custody since 25.09.2017.

Learned counsel for the State submits that petitioner was absconder, it's a case of the year 2013 and impugned order

Patna High Court Cr.Misc. No.62393 of 2017 (3) dt.02-02-2018 2/2 shows that in a split up case trial is at the fag end and the evidence as appeared came against the petitioner as having shot at the deceased.

Having considered the aforesaid facts and circumstances of the case, the prayer for bail of the petitioner is rejected. Trial court is directed to expedite the trial. (Arun Kumar, J) Sujit/- U T
