From perusal of the order sheet No. 4 dated 16.6.2020, it transpires that the complainant has filed an affidavit that petitioner has already solemnized his second marriage but the petitioner has denied this fact in Paragraph-10 of his bail petition. Thereafter, the learned coordinate Bench issued a direction to Superintendent of Police, Araria to inquire into the matter and report.
Order dated 11.9.2020 shows that a report of the Superintendent of Police, Araria vide report dated 3.7.2020 was received and it was reported that the petitioner has solemnized
Patna High Court CR. MISC. No.65853 of 2019(14) dt.27-10-2021 2/2 his second marriage with Khusbu Devi, D/o Mahadeo Thakur, resident of village Karhagola Khushalpur Tola, P.S. Barari, District Katihar.
Order dated 24.9.2020 of the learned coordinate Bench shows that the petitioner has admitted his second marriage but it was averred that the second marriage was solemnized after getting a Decree of Divorce from the competent court. The learned coordinate Bench directed the petitioner to place the copy of judgment and Decree of the Divorce Case before this Court but despite the order passed on 24.9.2020, the petitioner did not furnish the copy of the judgment of Decree of Divorce up till now.
In these circumstances, I do not think it a fit case for grant of anticipatory bail. Accordingly, the prayer for anticipatory bail is rejected.
If the court below finds that there is a chance of mediation, the recourses of District Mediation Center may be taken.
