This application for grant of regular bail arises out of Samastipur (Mufassil) P.S. Case No. 227 of 2020 registered for the offence punishable under Sections 302, 201 and 120-B of the Indian Penal Code.

The deceased was killed by unknown criminals. After ten days of killing of the deceased, one Rahul Kumar appeared before the Police and claimed himself to be the friend of the deceased and an eye witness to the incident. His statement has been recorded under Sections 161 and 164 of the Cr.P.C. In both the statements, Rahul Kumar has said that the petitioner and others have killed the deceased.

Considering the direct evidence against the petitioner, I am not inclined to grant the petitioner privilege of regular bail. Accordingly, this application is rejected. If there is no substantial progress in the trial, the petitioner may move before this Court for bail.
