JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Jadopur P.S. Case No. 52 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

Allegation as per FIR is of recovery of 192 litres of liquor from the vehicle parked in front of house of the petitioner. Submission of learned counsel for the petitioner is that he has falsely been implicated only because the vehicle was parked in front of his house and he has no criminal antecedent. Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner stating that there is specific allegation against the petitioner in the FIR. In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the

Patna High Court CR. MISC. No.60188 of 2019(2) dt.23-09-2019 2/2 petitioner. He may surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

With the above observation, this application is dismissed.
