This is an application for grant of anticipatory bail in connection with Habibpur PS case no. 75 of 2016 registered for the offences punishable under Sections 420, 406, 467, 468, 120B, 341, 386, 327, 504/34 of Indian Penal Code.
The allegation in the present case is that after the petitioner herein had executed sale deed in favour of the informant and the informant was constructing his boundary wall, ransom was demanded by one Surendra Yadav and thereafter, the said Surendra Yadav is said to have also received a ransom of Rs. 50,000/-. Subsequently, when the building was being constructed, co-accused namely Sonu Yadav came there and threatened the
Patna High Court Cr.Misc. No.62967 of 2017 (3) dt.11-01-2018 2/2 informant side and extracted a ransom of Rs. 3 lacs. The learned counsel for the petitioner submits that the petitioner has got no connection with the alleged occurrence and infact, no part of the allegation made by the informant point out towards the petitioner herein.
Having regard to the facts and circumstances of the case, more particularly the fact that no allegation of any type of criminal activities has been leveled against the petitioner herein, the abovenamed petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate-XII, Bhagalpur in connection with Habibpur PS case no. 75 of 2016 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
