The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467 and 406 of the Indian Penal Code.

The prosecution case is that informant Mukesh Kumar gave Rs.3,00,000/-, during 18.12.2016 to 20.12.2016 to the petitioner for supplying gold ornaments. It is also alleged that this petitioner supplied ornaments worth Rs.1,83,836/- but the same was subsequently found fake and thereafter in spite of several reminders neither the money was returned nor the original jewellery was supplied. No.61646 of 2017 (2) dt.20-12-2017 2/2 petitioner that the petitioner supplied certain jewellery on credit but the payment was not paid for which petitioner filed Complaint Case No. 873 of 2017 against the informant, wherein processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 504 and 417/34 of the Indian Penal Code in which the informant obtained bail and thereafter lodged the present frivolous case. There is no proof with regard to the payment by the informant to the petitioner.

Considering the nature of accusation and the lodging of the case by the petitioner at earlier point of time, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Rajiv Nagar P.S. Case No. 245 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
