The petitioner apprehends his arrest in connection with Bihta (Neora O.P.) P.S. Case No. 295 of 2023, registered for the offences punishable under Sections 419, 420, 406, 504, 506/34 of the Indian Penal Code.

Allegedly, the accused persons took money from the informant in lieu of registering a land and later on, the accused persons demanded much more money than the agreement entered into between the parties and threatened him of dire consequences. Learned counsel for the petitioner has submitted that the informant and the co-accused persons namely, Sujit Kumar and

Patna High Court CR. MISC. No.68849 of 2023(2) dt.02-11-2023 2/2 Ashwini Kumar are land brokers. Though the petitioner is a landlord but he is not a party to the transaction, in question. The transaction was between Sujit Kumar and Ashwini Kumar on the one hand and the informant, Amarnath Verma on the other. The petitioner has no relation with that transaction, in question. Moreover, the co-accused Sujit Kumar and Ashwini Kumar have been granted bail. The petitioner is a person of clean antecedent.

Learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances coupled with the fact that the petitioner is a man of clean antecedent, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist/concerned court, Danapur, District-Patna in connection with Bihta (Neora O.P.) P.S. Case No. 295 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
