Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in connection with Mohiuddin Nagar P.S. Case No. 160 of 2020 registered for the offences punishable under Sections 386, 120 B and 115/34 of the Indian Penal Code.

Allegedly, this petitioner and co-accused persons made an extortion demand from the informant and his wife and also threatened to kill the informant, if the said demand was not fulfilled and later on, petitioner and co-accused persons again

Patna High Court CR. MISC. No.64243 of 2022(2) dt.07-12-2022 2/3 came at the house of the informant and threatened for the extortion demand made earlier.

The main submissions advanced by learned counsel Mr. Ajay Kumar, appearing for the petitioner are that the petitioner earlier preferred Cr. Misc. No. 2783 of 2022 for regular bail which was rejected by this Bench but the petitioner is given a liberty to renew his bail prayer after framing of charge and in view of this liberty the petitioner has again come before this Court for the relief of regular bail and upon him charges have been framed on 19.07.2022 and he has been languishing in jail since 06.10.2020. Further submission is that a similarly situated co-accused person namely Praful Singh @ Praful Kumar Singh has been granted bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc. No. 41505 of 2021 and the maximum punishment for the alleged offence which mainly attracts in this case is three years and the alleged offences are triable by 1st Class Magistrate.

Learned APP Mr. Satya Nand Shukla, appearing for the State has opposed the prayer for bail.

Though the allegation appearing against the petitioner from the FIR is serious in nature but considering his custody period and also the fact that upon him charges have been framed

No.64243 of 2022(2) dt.07-12-2022 3/3 and his case is at initial stage of trial and one co-accused person is on bail and the alleged offences are triable by 1st Class Magistrate, in the opinion of this Court, a lenient approach can be taken in respect of the petitioner's prayer. Accordingly, let the petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Mohiuddin Nagar P.S.
