1. Heard learned counsel for the parties.

2. The petitioner has renewed his prayer for grant of regular bail in connection with Special Case no.163 of 2024, arising out of Digha P.S. Case no.578 of 2024 registered under sections 8(c) and 20(b) of the N.D.P.S. Act.

3. As per the prosecution case, on a search being conducted 3.446 kgs of ganja was recovered from the bag on the motorcycle which the petitioner and co-accused Nitish Kumar were riding.

4. Learned counsel for the petitioner submits that the earlier application for bail of the petitioner was rejected vide order dated 11.4.2025 passed in Cr. Misc. no.1294 of 2025 giving liberty to the petitioner to renew his prayer for bail on

Patna High Court CR. MISC. No.63938 of 2025(2) dt.19-09-2025 2/2 completing 1 year in custody. The petitioner has remained in custody for over 1 year since 28.8.2024. He undertakes to cooperate in the trial in the learned trial Court.

5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the F.I.R., the liberty granted in the earlier order of rejection dated 11.4.2025 and the petitioner having remained in custody for more than 1 year since 28.8.2024, the petitioner is directed to be enlarged on bail in connection with Special Case no.163 of 2024 (arising out of Digha P.S. Case no. 578 of 2024) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge (N.D.P.S.) Act, Patna.
