JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-10-2019 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 09.07.2019 in a case registered for the offences punishable under Sections 409, 420, 467, 468, 469, 470 and 471 of the IPC. It is alleged that the petitioner, being the Sub-Postmaster and co-accused, Manish Kumar Mishra, being the Postal Assistant misappropriated government money altogether to the tune of Rs. 6,73,200/-. It is specifically alleged that the petitioner individually misappropriated Rs. 2,68,000/-. It is submitted by learned counsel for the petitioner that Rs. 8,000/- per months is being deducted from the salary of the petitioner for recovery of the misappropriated amount and the investigation has already been concluded.

Learned APP submits that the petitioner is named in the

Patna High Court CR. MISC. No.62586 of 2019(2) dt.25-10-2019 2/2 FIR with specific accusation.

Considering the fact that investigation has already been concluded and the quantified misappropriate amount is being deducted from the salary of the petitioner, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned CJM, Motihari, East Champaran in connection with Govindganj (Malahi) P.S. Case No. 71 of 2019.
