The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 406, 420 and 34 of the Indian Penal Code pending in the learned court below.
Allegation against the petitioner is that he has present on the spot when the agreement of selling the truck between the petitioner and informant was signed.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further that there is no specific overt act against the petitioner. He submits that petitioner has not signed any agreement paper and paper agreement is not enclosed in the
Patna High Court CR. MISC. No.64749 of 2022(2) dt.16-01-2023 2/2 FIR. He further submits that petitioner have got no criminal antecedent as stated in para-3 of the bail application. Per contra, learned APP for the State vehemently opposing the bail application and submitted that the allegation levelled as the petitioner is serious in nature. Hence, he does not deserve anticipatory bail.
Considering the impugned order and after going through the case diary, I am not inclined to enlarge the petitioner on bail in connection with Rajpur P.S. Case No. 44/2022. Accordingly, his prayer for anticipatory bail is hereby rejected. (Anjani Kumar Sharan, J) ajay/- U T
