Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 15.12.2016 passed in Cr. Misc. No.48833 of 2016 with an observation that the learned trial court shall expedite the matter and conclude it as soon as possible, as there is recovery of huge quantity of explosive substance. Submission of the learned counsel for the petitioner is that the petitioner is in custody since 9.10.2015 and up-till-now not a single witness has been examined in this case and he has no criminal antecedent. Further submission is that the recovery is from the field of the petitioner at the instance of the other coaccused persons and not from the house or possession of the petitioner.

Patna High Court Cr.Misc. No.60936 of 2017 (4) dt.07-02-2018 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Addl. Sessions Judge, Bhojpur at Ara in connection with S.Tr. No.151 of 2017 arising out of Azimabad P.S. Case No.59 of 2015 with condition that he will cooperate in disposal of the trial and will also appear as and when required by the learned court below and he will also appear before the local police station of his area in the first week of each month for a period of one year so that the police may watch is conduct, otherwise his bail bond shall be cancelled.

With the aforesaid observation, this application is allowed.
