The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case instituted for the offences under Sections 341, 342, 323, 324, 326(A), 379, 447, 448, 504 and 506/34 of the Indian Penal Code. Prosecution allegation, in short, is that petitioner is said to have assaulted the informant with sharp edged weapon and also poured acid upon Dulari Devi and Rima Devi. Patna High Court CR. MISC. No.75836 of 2019(6) dt.09-09-2020 2/2 criminal antecedent. Charge-sheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case due to previous enmity. The earlier bail application of the petitioner was rejected vide Annexure-1 to this application by a Coordinate Bench of this Court. The petitioner has remained in custody for more than two years. The petitioner further undertakes to cooperate during the trial.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge-XIII, East Champaran at Motihari in connection with Chiraiya P.S. Case No. 136/2018 (Sessions Trial No. 567/2018).
