Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioner seeks bail in connection with Begusarai Town (Lohiyanagar O.P.) P.S. Case No. 210 of 2020 registered for the offence under Sections 420, 467, 468, 471, 120(B) and 34 of the Indian Penal Code (for short 'I.P.C.'). The accused/petitioner is named in the F.I.R. and is in custody since 19.08.2022.
The allegation against the petitioner is to sell out joint family property bearing descriptions as set out through F.I.R., where Jamabandi of the alleged land as in the favour of

Learned counsel appearing on behalf of the petitioner submitted that the property in issue is joint family property, where issue of Jamabandi is pending for considering before Competent Authority. It is also pointed out that petitioner only sell out the property of his own share. While concluding the argument, it has been submitted that petitioner is a man of clean antecedent and moreover, investigation has been completed, for which, charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.
Learned APP duly assisted by learned counsel appearing on behalf of the informant, while opposing the prayer of bail submitted that Jamabandi of the land in issue is in favour of informant and also submitted that partition of property has already been made between the parties but conceded that petitioner is one of the co-sharer with informant. Considering the facts and circumstances as mentioned above, as petitioner is one of the co-sharer with informant coupled with the fact that charge-sheet has already been submitted, let the petitioner, above named, is directed to be released on bail in connection with Begusarai Town (Lohiyanagar O.P.) P.S. Case No. 210 of 2020 on furnishing bail

No.64399 of 2022(2) dt.21-02-2023 3/3 bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai/concerned court, subject to the conditions as mentioned under Section 437 (3) of the Cr.P.C.
