The petitioner apprehends his arrest in Kudra P.S. case No. 226 of 2017 for the offences punishable under Section 414/34 of the Indian Penal Code.

The police raided the house of Shyam Bihari Bind and Tuntun Bind and from their possession submersible pump sets, wire etc were recovered. Shyam Bihari Bind and Tuntun Bind are alleged to have confessed their guilt before the police and Shyam Bihari Bind disclosed the name of the petitioner as one of his accomplices.

The learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and save and except confessional statement of Shyam Bihari Bind there is no material

Patna High Court Cr.Misc. No.63526 of 2017 (2) dt.12-01-2018 2/2 to show that petitioner ever committed any theft or any theft article is recovered from the house or possession of the petitioner. Considering the fact that save and except confession of Shyam Bihari Bind there is no tangible material against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Kaimur at Bhabua in connection with Kudra P.S. case No. 226 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
