Petitioner who is in custody seeks bail in a case registered for the offence punishable under Section 302, 201/34 of the IPC. Informant who is the Chowkidar has alleged in his fardbeyan that while he was on his morning patrolling duty he saw two dead bodies thrown near NH.30 Brahamasthan who were killed by sharp cutting weapon and they were identified as Poonam Dom and Santosh Dom. During investigation on the basis of confessional statement made by petitioner no.1 Munni Dom the weapon used in the commission of the crime was recovered from the house of petitioners who further confessed that on account of some family dispute the deceased was killed by petitioner no.1 Munni Dom and thereafter allegation against the petitioner no.2 and 3 is of helping in concealing dead bodies. Patna High Court CR. MISC. No.60481 of 2019(3) dt.10-01-2020 2/2 petitioner no.1 of committing murder of two of his family members, one is father and other relative as such I am not inclined to grant bail to petitioner no.1. Hence, the regular bail petition of petitioner no.1 is hereby rejected.

However, allegation against the petitioner no.2 and 3 is of helping in concealing the dead body of deceased. Petitioner No.2 and 3 have no criminal antecedent and are in custody since 24.03.2019. Considering the aforesaid facts and circumstances of the case, prayer of regular bail as against petitioner no.2 and 3 is allowed and in the event of their arrest or surrender before the court below within four weeks from today, petitioner no.2 and 3 are directed to be released on bail on furnishing bail bonds of Rs. 20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Nawanagar (Sonbarsa) P.s.
