JUSTICE ARUN KUMAR ORAL ORDER 24-01-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody, seeks bail in Deepnagar PS Case No. 325 of 2017 registered under Sections 365 and 366A/34 of the IPC.

The allegation in brief is that the informant's daughter had gone with the elder sister and brother-in-law to visit a fair but did not return.

Learned Counsel for the petitioner submits that the petitioner is younger brother of the son-in-law of the informant. The informant's daughter had gone along with her brother-in-law and elder sister and there was some affair with the petitioner so both eloped away but later on the girl under the influence of the parents has returned. Her age is not 13 years as stated in the FIR but she is above 18 years and the police has submitted charge-sheet. Having considered the said facts and circumstances, the petitioner, namely, Mukesh Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM IV Nalanda at Biharsharif in connection with Deepnagar PS Case No. 325 of 2017.
