JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 24-09-2019 This application under Articles 226 and 227 of the Constitution of India has been filed by the petitioner for quashing the first information report (for short 'FIR') of Siwan Mufassil P.S. Case No. 317 of 2019 registered under Section 366-A read with 34 of the Indian Penal Code.

The petitioner is neither the informant nor the accused in the instant case. She claims herself to be the wife of one Dhananjay Kumar Yadav, who has been made named accused in the case.

Patna High Court CR. WJC No.1365 of 2019(2) dt.24-09-2019 2/2 Since Dhananjay Kumar Yadav or any other accused named in the FIR has not joined as petitioner in the present application, I am not inclined to entertain this application. The accused person cannot pursue a proxy litigation by setting up the alleged victim for quashing the FIR.

The application is dismissed.
