The petitioners are in custody since 24.07.2019 in connection with Sursand P.S. Case No. 262 of 2019 for the offence registered under Sections 30(a) (38(1), 41 of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioners submits that the alleged recoveries were not made from the conscious possession of the petitioners and they have been falsely implicated in the
Patna High Court CR. MISC. No.60433 of 2019(2) dt.30-09-2019 2/2 present case. It is further submitted that the petitioners have no criminal antecedents.
Considering the aforesaid facts and circumstances of the case, let the petitioners, namely, Anand Kumar, Suresh Kumar, Shivam Kumar Chaudhary, Krishana Mandal and Fakira Mandal be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J.- II-cum-Special Judge, Excise Act, Sitamarhi in connection with Sursand P.S. Case No. 262 of 2019.
