Petitioner, who is in custody, seeks bail in a case, registered for the offence punishable under Section 392 of the Indian Penal Code.
Informant has alleged in his written complaint that on 26.04.2019 at about 11:30 AM, after collecting Rs. 39,000/-, he kept the said amount in dickey of the motorcycle and moved towards Registry office and as he proceeded from the house of the Rita Devi by motorcycle, son of Rita Devi, namely, Prince Kumar, followed him by motorcycle and two persons who had covered their identity, on strength of arm, took away the said amount from his dickey. However, during the occurrence, the face of the culprits were uncovered and they were identified as
Patna High Court CR. MISC. No.60163 of 2019(3) dt.27-11-2019 2/2 Monu Kumar (petitioner) and Laltu Yadav. The looted motorcycle was recovered on the confession of the petitioner. The petitioner has criminal antecedent.
It is submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case. The petitioner is in custody since 25.06.2019.
Considering the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.
