JUSTICE MADHURESH PRASAD ORAL ORDER 02-02-2018 Heard counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under sections 302, 34 and 120B IPC Counsel for the petitioner submits that the FIR was lodged six days of the incident of drowning of informant's son, though a UD case had been instituted on the same day in this regard. He submits that subsequently on the basis of suspicion created due to threats given by other persons to the informant and as petitioner was last seen with the deceased, he has been implicated in this case. Prior to the lodging of this case, he is not accused in other case. Petitioner is in custody since 7.11.2017.

Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Saharsa Sadar Police Station Case No. 988 of 2017 on he following conditions:- (i) One of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to

(ii) The petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
