JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-06-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with R.C. Case No. 2172017A0012 of 2017 for the offence under Sections 409, 420, 467, 468, 471 read with 120B of the Indian Penal Code and Section 13(2) read with Section 13(1)(c) and 13(1)(d) of the Prevention of Corruption Act. Mr. Ajay Kumar Thakur, learned counsel for the petitioner submits that the present anticipatory bail application may be disposed of with liberty to the petitioner to surrender before the court below and pray for regular bail. Learned counsel for C.B.I. submits that the application for regular bail shall be considered by the court below on its own merit.

Considering the aforesaid, the present application is

Patna High Court CR. MISC. No.58070 of 2019(6) dt.12-06-2020 2/2 disposed of with liberty to the petitioner to approach the court below for grant of regular bail.

In case, the petitioner surrenders before the court below within one month from today and prays for regular bail, the same will be considered and disposed of on the same day on its own merit without being prejudiced by the order of this Court.
