JUSTICE PRABHAT KUMAR JHA ORAL ORDER 11-01-2018 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned Additional P.P. for the State.

The petitioner apprehends her arrest in Pusa P.S. Case No.79 of 2017 registered under Sections 341, 323, 325, 307, 379, 504, 506, 36 of the Indian Penal Code.

The informant alleged that his sister, Kajal Kumari was tying ropes after standing on the wall of the informant. Some alteration took place. The accused persons pushed her down on the ground. Prashant Kumar Niraj is said to have assaulted the informant with hammer causing injury and his teeth were uprooted. Abhishek assaulted the informant with iron rod. Elder

Patna High Court Cr.Misc. No.63430 of 2017 (2) dt.11-01-2018 son-in-law of Satya Narain Das assaulted with axe. The petitioner is alleged to have snatched Mangal Sutra from the possession of Varsha Kumari, sister of the informant.

The learned counsel for the petitioner submits that petitioner is a lady. There is no allegation of assault against the petitioner. The allegation of snatching Mangal Sutra is ornamental.

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the petitioner is a lady, the petitioner, above named, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VI, Samastipur, District-Samastipur in connection with Pusa P.S. Case No.79 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
