2. The petitioner apprehends his arrest for the offences alleged under Sections 126(2), 115(2), 118(2), 109, 74, 329, 351(2), 352, 3(5) of the B.N.S. registered in connection with Bijdhari P.S.Case No. 43 of 2025.
3.As per allegation, the petitioner along with other accused persons abused and assaulted the informant and his wife, causing them injuries.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. It is further submitted that the injuries inflicted upon the injured
Patna High Court CR. MISC. No.65320 of 2025(3) dt.31-10-2025 2/2 persons are found to be simple in nature and there is case and counter case between the parties. It is also submitted that similarly situated co-accused persons have been granted anticipatory bail by this Court in Cr.Misc.No. 65203 of 2025 under order dated 16.10.2025.
5. On the other hand, the learned counsel for the informant opposed the prayer for anticipatory bail.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Bijdhari P.S.Case No. 43 of 2025, subject to the conditions as laid down under Section 438(2) CrPC/482(2) of the BNSS, 2023.
