JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-09-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Barauni Rail P.S. Case No. 74 of 2019 for the offence under Sections 401, 414/34 of the Indian Penal Code, Sections 137/147 of the Indian Railways Act and Sections 20/22 of the NDPS Act.

Allegation against the petitioner is that during search from his possession Rs.100/-, Aadhar Card and PAN Card of Ranjay Singh as well as one leaf of 12 tablet of Ativan was seized.

Learned counsel for the petitioner submits that the petitioner is suffering from mental ailment and he is under treatment at Davis Institute of Neuropsychiatry, Boreya Road,

Patna High Court CR. MISC. No.57910 of 2019(2) dt.30-09-2019 2/2 Kanke, Ranchi and the drug which was recovered from the possession of the petitioner was prescribed by Dr. M. Borde. The petitioner is in custody since 20.06.2019. Considering the aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge-cumSpecial Judge (NDPS Act), Begusarai in connection with Barauni Rail P.S. Case No. 74 of 2019.
