2. The petitioners seek bail in connection with Gaya Excise P.S. Case No. 1525 of 2023 registered for the offence under Sections 30(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016.

3. Learned counsel for the petitioners submits that the petitioners are in custody since 27.08.2023 and there is recovery of 374 litres of illicit liquor from their possession. He further submits that petitioners are ready to donate Rs. 20,000/- (Rupees Two Thousand Only) each in some charitable organization.

4. Learned APP has vehemently opposed the prayer of

Patna High Court CR. MISC. No.67930 of 2023(2) dt.18-10-2023 2/2 bail.

5. Considering the period of custody and recovery of illicit liquor, this application for regular bail is allowed.

6. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No. III, Gaya in connection with Gaya Excise P.S. Case No. 1525 of 2023.

7. Petitioners' bail bond shall be accepted only after they deposit Rs. 20,000/- (Rupees Twenty Thousand Only) each in Ram Krishna Mission, Patna and produce the receipt of the same and after verification of the genuineness of the receipt the petitioners shall be released.
