This is an application for grant of anticipatory bail in connection with Jagdishpur P.S. Case No. 377 of 2017 registered for the offence punishable under Sections 341, 323, 324, 307 and 34 of the Indian Penal Code.
The allegation against the petitioner is assaulting the brother of the informant, namely Chandan Kumar by axe on his head, however, the injury report which has come on record in the case dairy, show the injury to be simple in nature. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and there is no injury on the head of the injured, hence, the allegation levelled against the petitioner regarding assaulting on head is
Patna High Court Cr.Misc. No.62222 of 2017 (3) dt.24-01-2018 2/2 false. It is further submitted that the petitioner has a clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner herein on anticipatory bail in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur in connection with Jagdishpur P.S. Case No. 377 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
