The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 324, 504, 506, 307, 448, 427, 379 and 34 of the Indian Penal Code. Earlier prayer for bail was rejected on 18.01.2019 in Cr. Misc. No. 74/2019. So far as the petitioner is concerned the allegation against him is of assault by Dabiya blow on the head of the victim.

Learned counsel for the petitioner submits that the petitioner had liberty to renew his prayer for bail after six months, if no substantial progress is made in the trial. The petitioner is in custody since 16.04.2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses

Patna High Court CR. MISC. No. 61219 of 2019(3) dt.06-02-2020 2/2 alleged against the petitioner and the case has been committed to the court of sessions.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul, in connection with Pipra P.S. Case No. 174 of 2018, subject to the following condition that the petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
