2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 354 , 379, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, this petitioner pressed the neck of the informant by his leg and when

Patna High Court CR. MISC. No.67542 of 2023(2) dt.19-10-2023 2/3 husband of the informant and others came to rescue, all the accused persons assaulted them. It is further alleged that on the point of gun , this petitioner threatened the husband of the informant to kill him.

4. Learned counsel for the petitioner submits that both the parties are neighbour and due to some petty dispute, this false and concocted case has been lodged. Rest of the allegation is super-addition to make the case grave .

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate - 1st Class, Motihari, East Champaran in connection with Turkauliya (Raghunathpur) P.S. case No. 220 of 2023 , subject to the conditions laid
