Mr.Ram Naresh Ray ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-09-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case, registered for the offence under Sections 80, 238, 3(5) of the B.N.S., 2023.
3. The prosecution case, in brief, is that daughter of informant Nikki Kumari was married with co-accused Vikram Kumar in the year 2024 and it is alleged that she was pregnant and was given medication to abort the pregnancy, which led to
Patna High Court CR. MISC. No.64923 of 2025(2) dt.17-09-2025 2/3 significant bleeding and she was admitted to a private hospital where she underwent a DNC on 09.05.2024. It is further alleged that on 18.05.2024 at 7 pm, the informant's daughter was badly assaulted by accused persons and her mobile was snatched, but anyhow, she could save her life and went to her parents' house, whereupon Mushhari P.S. Case No. 138 of 2024 was registered. After that, the accused persons accepted to take good care of the informant's daughter and took her home and on that basis, coaccused Vikram Kumar got bail from this Honorable High Court. It is further alleged that on 10.05.2025 at around 9 pm, the accused persons demanded Rs. 5 lakhs, as dowry, from informant and also threatened to kill Nikki (informant's daughter), if the dowry demand is not fulfilled and it is alleged after 10-11 days, on inquiry, the informant received an information that the accused persons have killed her daughter while she was pregnant and disappeared her dead-body and accordingly, present F.I.R. was lodged.
4. Petitioner nos. 1 & 2 are brother-in-law, petitioner no. 3 is father-in-law, petitioner no. 4 is mother-in-law and petitioner no. 5 is sister-in-law of the deceased. There is general and omnibus allegation. Thrust of the accusation is against husband of the deceased, who is already in custody since
Patna High Court CR. MISC. No.64923 of 2025(2) dt.17-09-2025 3/3 11.06.2025. Petitioners are separate in mess and property and have got no concern with the family affairs of deceased and her husband.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of petitioners.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Muzaffarpur / concerned Court in connection with Mushari P.S. Case No. 132 of 2025 subject to condition as laid down under Section 482 of the B.N.S.S., 2023. (Prabhat Kumar Singh, J) anay U T
