JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 This is an application for grant of anticipatory bail in connection with Excise Case No. 206 of 2018, disclosing offences under Sections 30 (Ka) and 56 (Gha) of the Bihar Prohibition and Excise Act, 2018.

There is recovery of 06 liters of liquor from the vehicle of the petitioner.

Submission of the learned counsel for the petitioner is that driver has taken the family members to some other place and in return the vehicle was apprehended and at the time of recovery, petitioner was not present there. He is ready to abide by any condition imposed on him.

Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, as stated above, this application is disposed of

Patna High Court CR. MISC. No.59682 of 2019(2) dt.23-09-2019 2/2 with a direction to the petitioner to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on the basis of materials in the case diary, and if possible, be disposed of on the same day.
