The petitioner seeks regular bail in connection with Jagdishpur P.S. Case No. 243 of 2017 for the offences punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding recovery of 63 liters of country made liquor from a tent house of the petitioner. The learned counsel for the petitioner submits that the said tent house belongs to the son of the petitioner, the petitioner has nothing to do with the same, he is aged about 74 years old and has been falsely implicated in this case. It is further submitted that the petitioner has a clean antecedent and he is in
Patna High Court Cr.Misc. No.63645 of 2017 (2) dt.17-01-2018 2/2 custody since 22.8.2017.
Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has a clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Bhojpur, Ara in connection with Jagdishpur P.S. Case No. 243 of 2017.
